Disclaimer & Liability Waiver

Effective Date: January 1, 2025

By booking or participating in any safari, tour, or activity organized by Kipruto Safaris, you acknowledge that you have read, understood, and agreed to the following terms and conditions of this Disclaimer and Liability Waiver.

1. Assumption of Risk

Travel and safari activities inherently involve certain risks, including but not limited to wildlife encounters, rough terrain, accidents, unpredictable weather, natural hazards, or transportation challenges.
By participating in our safaris, you voluntarily assume all such risks, whether expected or unexpected, and agree that Kipruto Safaris shall not be liable for any injury, loss, or damage resulting from these risks.

2. Limitation of Liability

While we take every reasonable precaution for your safety and satisfaction, Kipruto Safaris shall not be held responsible or liable for:

  • Personal injury, illness, loss, or death during the safari

  • Delays, cancellations, or additional expenses arising from weather, traffic, natural disasters, pandemics, or government actions

  • Acts, omissions, or negligence of any third-party providers (including hotels, airlines, or park authorities)

  • Loss or damage to personal property, baggage, or equipment

Our total liability, under any circumstances, shall not exceed the total amount paid directly to Kipruto Safaris for the affected portion of the safari.

3. Relatives, Guardians, and Legal Representatives

You hereby agree that this waiver and release of liability shall be binding upon your heirs, next of kin, family members, executors, administrators, legal representatives, and assigns, who shall have no right to claim or sue Kipruto Safaris, its directors, employees, agents, or partners for any matter arising from your participation in the safari.

If you are traveling as a parent or legal guardian of a minor, you agree to accept full responsibility for the child’s welfare and behavior, and to release Kipruto Safaris from any and all liability arising from the child’s participation.

4. Travel Insurance

All guests are strongly advised to obtain comprehensive travel insurance covering medical expenses, trip interruption, evacuation, loss of baggage, and personal liability.
Kipruto Safaris shall not be liable for any costs, losses, or damages not covered by your personal insurance policy.

5. Health, Safety, and Conduct

Guests are expected to:

  • Follow all instructions and safety guidelines provided by our guides and park authorities

  • Declare any medical conditions or allergies prior to travel

  • Behave respectfully towards wildlife, local communities, and fellow travellers

Kipruto Safaris reserves the right to terminate participation, without refund, for any traveller whose behavior endangers themselves, others, or the environment.

6. Force Majeure

Kipruto Safaris shall not be held liable for failure to perform its obligations due to circumstances beyond its control, including but not limited to natural disasters, strikes, civil unrest, pandemics, government restrictions, or acts of terrorism.

7. Acceptance of Terms

By confirming your booking, making payment, or participating in any safari organized by Kipruto Safaris, you:

  • Acknowledge that you have read and understood this waiver;

  • Accept all risks associated with participation; and

  • Release Kipruto Safaris, its owners, employees, agents, affiliates, and partners from any and all liability, claims, or demands arising out of your safari experience — including those brought by relatives, guardians, or representatives.

8. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Kenya.
Any dispute shall be resolved exclusively under Kenyan jurisdiction.
